MandM files motion and injunction in Pavilion dispute

MandM LLC, the contract buyer of the Pavilion a.k.a. Better Way Courtplex, has filed their own motion and injunction in District Court for Webster County Thursday afternoon. 

According to the motion, MandM LLC attests that they have made requests consistent with the Furniture, Fixtures, and Equipment clause of the real estate contract, to which the City has withheld approval or refused to reimburse. 

The motion argues the City attempted to “take over” the property, and since the issuance of the Notice of Forfeiture of Real Estate Contract, potential sponsors have refused to purchase sponsorships. The filing notes instances in which sponsors have called to cancel their contracts. The filing also notes a management entity has indicated it will not enter into an agreement amidst the ongoing dispute.

MandM LLC is seeking a declaratory judgement, temporary and permanent injunction, as well as damages, attorney’s fees, and other costs the Court deems equitable.
