The ongoing property dispute over ownership of the Pavilion, located in Corridor Plaza, officially landed in court this week.
Legal counsel for the City of Fort Dodge filed a Petition for Forcible Entry and Detainer Tuesday morning. The filing, prepared by Dorsey & Whitney LLP out of Des Moines, alleges that MandM LLC has failed to vacate following contract forfeiture.
According to City Manager David Fierke, the City does still intend for the Pavilion to be a sporting events destination, but didn’t provide any further details due to the ongoing dispute.
We did reach out to Councilman McCubbin a few weeks ago in regards to his involvement with the Better Way Project and ties to the Pavilion. McCubbin advised he has no financial investment in The Better Way Project or the Pavilion. In the interest of transparency, he did name three other projects he does have investments in that also include some of the same individuals financially involved with The Better Way Project and / or Pavilion. He has received no compensation from any entity related to the Pavilion Project. He does have some properties listed with ties to The Better Way Project, but would only earn a commission if a sale occurs.
